§ 70-3. Enforcement and penalties.

  • (a)

    Responsibility for enforcement and administration. The administration and enforcement of the provisions of this chapter shall rest with the town building official or his designated representative.

    (b)

    Written notice of violation. The building official or his designated representative shall provide written notice to anyone in violation of the provisions of this chapter, specifying the nature of the violation and necessary corrective action.

    (c)

    Punishment for violations. If violations are not corrected in the time specified by the building official, the person or entity deemed to be in violation of this chapter shall be punishable as provided by F.S. § 125.69, F.S. ch. 162, the county citation ordinance or any other method provided by law.

    (d)

    Each day deemed separate violation. Each day that a violation of this chapter continues, after notice, shall constitute a separate violation of this chapter, and each separate violation may be punished, as set forth in subsection (c).

    (e)

    Authority to issue stop-work orders and seek injunctions Notwithstanding the criminal penalties provided by this chapter, the building official or his designated representative is authorized to issue stop work orders, as provided by the building code enforced in the town, to halt construction in violation of the provisions of this chapter, and the town council shall have the right to seek an emergency civil injunction from the circuit court in and for the county against the violator of any provision of this chapter, and if such injunction is granted, the violator shall pay all reasonable costs and attorney fees incurred by the town council in obtaining and enforcing such injunction.
